Terms of Service
These Terms of Service define the Capitalized Terms used in the SMS-TO.IT.COM policy set and describe the rules that govern access to and use of the service.
A. Scope and Acceptance
These Terms of Service govern access to and use of SMS-TO.IT.COM. By creating an account, purchasing a plan, purchasing Credits, or using the service, the user accepts these Terms of Service and the policy documents listed in the Policy Center.
B. Definitions
The following Capitalized Terms apply throughout this policy set:
- Account means the user account that accesses SMS-TO.IT.COM.
- Add-On means a separately priced recurring or one-time service element, including additional phone-number capacity, additional sender-email capacity, or other optional features that SMS-TO.IT.COM makes available.
- Billing Anchor means the recurring monthly Coordinated Universal Time (UTC) date and time that controls renewal timing and the expiration timing of subscription-tied Credits.
- Complimentary Test Messages means the limited static integration test messages that SMS-TO.IT.COM allows each Account to send without using Credits, subject to the conditions in the Billing Policy.
- Credits means the SMS sending units that the service allocates through a subscription plan or additional purchase.
- Current Subscription Period means the active paid subscription period that has already begun and has not yet ended.
- Downgrade Effective Date means the UTC date and time on which a requested downgrade takes effect under the Billing Policy.
- Service Data means the data the user supplies or generates through the service, including verified phone numbers, approved sender identities, queued messages, delivery logs, support messages, and account management events.
- Subscription means the recurring paid plan that provides included Credits, features, and resource limits.
- United States means the United States of America and its applicable state and federal legal regimes, including applicable California law.
C. Service Use
a. Permitted Use
SMS-TO.IT.COM provides a controlled bridge between approved sender identities, application interfaces, and verified recipient phone numbers. The user may use the service only in a lawful manner and only for traffic the user is authorized to send.
b. Prohibited Use
- The user must not use the service for unlawful activity, harassment, abuse, fraud, phishing, malware distribution, or spam.
- The user must not attempt to evade plan limits, Credit rules, Complimentary Test Message rules, pricing controls, account restrictions, or technical safeguards.
- The user must not abuse administrators, support staff, carriers, or other users.
D. Billing and Subscription Governance
The rules that govern Billing Anchors, Credit expiration, Add-Ons, upgrades, downgrades, cancellation timing, and Checkout disclosures appear in the Billing Policy and Checkout Disclosures. Those documents form part of these Terms of Service.
E. Privacy and Data Handling
The rules that govern Service Data, privacy rights, California privacy disclosures, and privacy operations appear in the Privacy Policy. The Privacy Policy forms part of these Terms of Service.
F. Refunds, Abuse, Suspension, and Termination
The rules that govern billing corrections, discretionary subscription-period refunds, abuse review, suspension, and termination appear in the Refund and Account Termination Policy. That policy forms part of these Terms of Service.
G. Service Availability and Warranty Disclaimer
SMS-TO.IT.COM provides the service on an "as is" and "as available" basis. Cellular delivery, upstream carrier availability, internet conditions, and third-party platform conditions may affect transmission, latency, or availability. To the maximum extent permitted by law, SMS-TO.IT.COM disclaims warranties that are not expressly stated in this policy set.
H. Governing Law and Service Region
SMS-TO.IT.COM operates from California and provides service for use within the United States. SMS-TO.IT.COM designs its customer-facing privacy and billing practices to support compliance with applicable United States law, including applicable California law, and also adopts privacy practices aligned with widely recognized international standards where practical.
